Content and Structure
Material concerning the workings and administration of the International Tribunal for the Former Yugoslavia. The Tribunal was a complex and unique international institution. The Office of the Prosecutor, the Registry, and the Judge's Chambers had complex and manifold tasks to perform.
However, it had significant stumbling blocks regarding management and the arrest of indicted persons. The Tribunal needed more staff members to expedite its mandate as efficiently as possible. Cassese was constantly seeking seconded staff to fill the gaps in order to fulfill its many pressing and demanding tasks. Insufficient staff resources were down to problems with the tribunal's budget. As the amount of work increased over time, there was always a shortfall, as the current year's budget was based on the previous year's activity. Instead, the Tribunal's expenditure increased as its workload grew.
Furthermore, the greatest obstacle that the Tribunal faced was the failure to arrest persons accused by the Tribunal of serious violations of international humanitarian law. This threatened the credibility of the ICTY, and Cassese, as these files demonstrate, pressed for the UN Security Council to take action and force those countries flouting international law to comply with their obligations to execute the Tribunal's arrest warrants.
